Rules for Partner referrals, commissions, and payouts.

A detailed operating draft for Partner approval, attribution, commission holds, refunds, disputes, disclosures, brand claims, prohibited promotion, tax records, and payout readiness.

Purpose and status

These Partner Terms govern participation in the TrendRise Partner program, including applications, approvals, referral links, Partner codes, Partner dashboards, approved promotional assets, attribution, commission eligibility, refund and dispute adjustments, payout readiness, manual payout fallback, Stripe Connect onboarding, disclosures, and related Partner activity.

  • These Partner Terms are a lawyer-review-ready operating draft and must be reviewed by counsel before final public launch.
  • They are written to protect TrendRise while giving support, finance, and Partner operations a practical rulebook for common questions.
  • They apply when a person or organization applies for, receives, uses, or benefits from a TrendRise Partner code, referral link, commission, payout preview, dashboard, promotional asset, or Partner relationship.
  • Questions should be sent to partners@trendrise.io, and legal notices should be sent to legal@trendrise.io.

Relationship to other terms

These Partner Terms supplement the TrendRise Terms of Use, Privacy Policy, Refund Policy, Cookie Policy, Data Processing Addendum where applicable, and any signed written Partner agreement. If a signed written agreement conflicts with these Partner Terms, the signed agreement controls for that Partner relationship unless it says otherwise.

  • The Terms of Use govern account access, acceptable use, credits, billing, refunds, AI outputs, source data, and product use.
  • The Refund Policy governs customer refunds, chargebacks, disputes, credit restoration, and refund evidence. Refunds and disputes can reverse, freeze, or adjust Partner commission.
  • The Privacy Policy and Cookie Policy govern Partner attribution cookies, referral metadata, dashboard records, and privacy requests.
  • Partner-specific rate cards, campaign terms, invite emails, approved assets, or dashboard notices may add offer-specific rules.

Independent relationship

Partners are independent promoters, creators, consultants, communities, agencies, affiliates, or businesses. A Partner is not a TrendRise employee, agent, joint venturer, franchisee, broker, fiduciary, legal representative, reseller, payment collector, or customer-support representative.

  • Partners may not bind TrendRise to contracts, refunds, discounts, warranties, support commitments, product roadmaps, legal conclusions, or custom terms.
  • Partners are responsible for their own business registrations, taxes, expenses, insurance, staff, contractors, tools, content, ads, and compliance obligations.
  • No minimum earnings, payout amount, referral volume, territory, audience exclusivity, or continued program access is guaranteed.
  • TrendRise may communicate directly with customers and prospects referred by a Partner.

Eligibility and application information

Partner access requires accurate application information and TrendRise approval. TrendRise may review the applicant, business identity, audience, countries served, channels, promotional methods, disclosure plan, brand fit, product familiarity, legal risk, payment-provider readiness, and program capacity.

  • A Partner must provide truthful, current, and complete application, contact, payout, tax, channel, and compliance information.
  • If an applicant applies on behalf of a company, agency, creator team, newsletter, community, or media property, the applicant must have authority to do so.
  • TrendRise may request additional verification, examples of prior content, channel ownership proof, tax forms, sanctions screening information, business documents, or identity verification before approval or payout.
  • TrendRise may reject, approve, conditionally approve, limit, pause, suspend, or revoke Partner access at any time.

Approval is discretionary

Approval is not automatic and does not create a permanent right to participate. TrendRise may approve only certain channels, offers, countries, languages, audiences, products, plan tiers, campaign types, or promotional methods for a Partner.

  • TrendRise may require a Partner to complete onboarding steps before referral links, codes, dashboards, commissions, or payouts become active.
  • TrendRise may withhold or remove Partner dashboard access if the Partner cannot be matched to an approved email, account, or business identity.
  • Approval of one Partner, campaign, link, code, post, or asset does not mean other activity is approved.
  • TrendRise may run invite-only, private, test, regional, capped, or time-limited Partner campaigns.

Partner account and dashboard access

Approved Partners may receive access to a Partner dashboard, settings page, referral links, commission records, payout status, approved assets, rules, and performance summaries. Dashboard data may be delayed, estimated, incomplete, or subject to later reconciliation.

  • Partners must protect login credentials and immediately report suspected unauthorized access.
  • Partner dashboard access may be limited to approved emails, workspace roles, admin inspection, or specific Partner codes.
  • TrendRise may change dashboard fields, labels, views, estimates, payout states, or reporting methodology as the product and Partner ledger evolve.
  • The dashboard is not a tax document, accounting system, payment guarantee, or substitute for Stripe, bank, or tax records.

Attribution limits

Attribution is a best-effort operational system, not a guarantee. A referral may not be attributed, or may be attributed differently, when technical, legal, customer, browser, payment, fraud, or product events prevent reliable matching.

  • Attribution may fail or change if a customer clears cookies, blocks tracking, rejects optional attribution where consent is required, uses another device, changes browsers, signs up outside the tracked path, uses a different email, disables storage, starts Checkout from another route, or buys after the attribution window.
  • A later Partner click, direct sales process, manual sales motion, coupon, platform limitation, region-specific consent rule, customer support correction, fraud review, or system reconciliation may override or remove attribution.
  • TrendRise may decide duplicate attribution, last-click versus first-click conflicts, coupon conflicts, self-referrals, account-merge conflicts, team purchases, agency purchases, and suspicious activity.
  • TrendRise has final authority over Partner attribution and commission eligibility unless a signed agreement says otherwise.

Qualified referrals and customers

A qualified referral generally means a real prospect who is new to TrendRise, reached through an approved Partner activity, properly attributed under TrendRise systems, and who completes a qualifying paid transaction without refund, dispute, fraud, abuse, policy violation, or excluded-plan status.

  • Existing customers, internal TrendRise accounts, test accounts, duplicate accounts, free-only users, invalid payments, fraudulent accounts, sanctioned users, self-referrals, and accounts created to manipulate commissions are not qualified referrals.
  • A customer must use accurate account and billing information and must not be created solely to generate commission.
  • TrendRise may exclude enterprise contracts, custom contracts, reseller arrangements, manual invoices, beta trials, free grants, staff accounts, discounted internal campaigns, refunds, chargebacks, and non-standard offers from Partner commission unless approved in writing.
  • TrendRise may require a customer to remain in good standing before commission becomes payable.

Commission eligibility

Commission eligibility depends on an approved Partner relationship, valid attribution, a qualifying customer payment, no disqualifying activity, and satisfaction of hold, refund, dispute, fraud, compliance, tax, and payout-readiness rules.

  • A commission is not earned merely because a click, signup, lead, free trial, checkout start, coupon entry, dashboard estimate, or unpaid invoice appears in a system.
  • Commission rates, eligible plans, excluded products, payout thresholds, payout schedules, currency rules, and offer-specific terms may be set in the Partner dashboard, invite email, signed agreement, or campaign notice.
  • TrendRise may calculate commissions from net revenue after refunds, disputes, taxes, discounts, credits, chargeback fees, payment-provider fees, currency adjustments, reversals, coupons, promotions, and excluded products where applicable.
  • Commission estimates may change until billing, refunds, disputes, taxes, chargebacks, payment fees, fraud review, and payout records are reconciled.

Commission hold and payable status

TrendRise-owned Partner commissions currently use a 20-day hold before becoming payable. The hold gives TrendRise time to detect refunds, payment failures, fraud, account abuse, disputes, chargebacks, duplicate accounts, and obvious attribution errors.

  • During the hold, commission may show as pending, held, estimated, under review, frozen, or another non-payable status.
  • A commission is not payable until the hold has expired, the customer payment remains valid, no refund or dispute blocks the payment, the Partner remains in good standing, payout setup is complete, any minimum threshold is met, and TrendRise approves the payout state.
  • TrendRise may extend a hold for high-risk customers, annual plans, unusually large purchases, suspicious traffic, dispute risk, manual invoices, agency purchases, tax review, sanctions review, or payment-provider restrictions.
  • TrendRise may shorten or change hold periods prospectively for specific campaigns, signed agreements, or operational needs.

Refunds, cancellations, disputes, and reversals

Customer refunds, chargebacks, payment disputes, payment failures, cancellations, fraud reviews, duplicate-charge corrections, and dispute outcomes can affect Partner commission.

  • Refunds reverse the related commission where applicable.
  • Disputes freeze pending or payable commission until the dispute closes.
  • Won disputes may restore commission to pending or payable based on the original eligibility date or TrendRise's reconciliation rules.
  • Lost disputes reverse unpaid commission or may create a negative adjustment against future payouts if the Partner was already paid.
  • If a customer receives a partial refund, credit, plan correction, tax correction, or billing adjustment, TrendRise may reduce the related commission proportionally or under the applicable campaign rules.
  • A Partner has no right to preserve commission for a refunded, disputed, reversed, fraudulent, unpaid, or non-qualifying customer transaction.

Negative balances and setoff

If TrendRise pays a Partner and later discovers a refund, dispute loss, fraud, billing correction, tax correction, duplicate payout, attribution error, or policy violation, TrendRise may create a negative adjustment, offset future commission, delay future payouts, request repayment, or use other lawful remedies.

  • Negative adjustments may appear as reversals, clawbacks, setoffs, balance corrections, or payout deductions.
  • TrendRise may withhold future payouts until negative balances are cleared.
  • TrendRise may decline to pay commission that is below a minimum threshold, subject to unresolved risk review, or not economically reasonable to process.
  • TrendRise may correct ledger mistakes even if a dashboard previously displayed a different amount.

Fraud, abuse, and self-referrals

Partners may not manipulate the Partner program, attribution systems, cookie systems, coupons, signups, trials, Checkout, customer accounts, refunds, disputes, reviews, or traffic sources.

  • Prohibited conduct includes self-referrals, fake signups, duplicate accounts, family or employee accounts created to generate commission, coupon abuse, click fraud, bot traffic, cookie stuffing, hidden iframes, forced clicks, malware, misleading redirects, domain spoofing, pixel stuffing, fake referrals, incentivized signups not approved by TrendRise, and refund-after-commission schemes.
  • Partners may not ask customers to create unnecessary accounts, hide their identity, file false disputes, evade eligibility rules, or misrepresent how they found TrendRise.
  • TrendRise may freeze attribution, commissions, dashboard access, and payouts while investigating suspicious activity.
  • TrendRise may permanently withhold commission tied to fraud, abuse, policy evasion, prohibited promotion, or breach of these Partner Terms.

Required disclosures

Partners must clearly disclose the commercial relationship with TrendRise whenever promoting TrendRise, using referral links, providing reviews, publishing tutorials, sharing discounts, using Partner codes, making recommendations, sending commercial messages, or creating sponsored, affiliate, ambassador, referral, or incentive-based content.

  • Disclosures must be clear, conspicuous, honest, unavoidable where required, close to the endorsement or link, easy to understand, and appropriate for the platform, language, country, and format.
  • A disclosure only on an About page, profile bio, footer, terms page, buried hashtag string, collapsed caption, link destination, or separate landing page may be insufficient.
  • Partners should use plain language such as ad, sponsored, paid partnership, I earn a commission, or similar language that a reasonable viewer understands in context.
  • A personalized discount code, Partner code, or platform disclosure tool may not be enough by itself where the audience may not understand the financial relationship.
  • For videos, livestreams, podcasts, short-form clips, stories, carousels, email, SMS, community posts, and live demos, disclosures must appear in the medium and at the time a reasonable viewer needs them.

Partners are responsible for complying with FTC endorsement guidance, platform rules, email/SMS rules, and local influencer, affiliate, advertising, and consumer-protection laws. TrendRise may require correction, takedown, retraining, suspension, or termination where disclosures are missing, unclear, hidden, or misleading.

Marketing claims and endorsements

Partners must be honest about their experience with TrendRise and may not make claims that TrendRise has not approved or cannot substantiate. A Partner endorsement must reflect the Partner's truthful opinion and actual experience.

  • Partners may not claim guaranteed revenue, guaranteed product-market fit, guaranteed traffic, guaranteed creator acceptance, guaranteed refunds, legal compliance, tax compliance, investment returns, health outcomes, employment outcomes, passive income, or business success.
  • Partners may not say they use TrendRise regularly if they have only tried it briefly, may not say TrendRise performed better than it did, and may not invent screenshots, results, reviews, customer stories, testimonials, or metrics.
  • Partners may not use fake reviews, fake testimonials, AI-generated fake customer quotes, purchased positive reviews, review suppression, fake social proof, fake scarcity, fake countdowns, or misleading before/after claims.
  • Partners must avoid unsupported comparisons against competitors, unverifiable superiority claims, and claims that require proof TrendRise does not have.
  • If TrendRise asks a Partner to correct, remove, archive, edit, or stop using a claim, the Partner must do so promptly.

Approved assets and brand use

Partners may use only approved TrendRise names, logos, screenshots, videos, copy, product descriptions, pricing references, offer terms, testimonials, case studies, comparison statements, and claims. TrendRise may update approved assets and require older assets to be removed.

  • Use the TrendRise name accurately. Do not imply ownership of TrendRise, official employment, exclusive rights, certification, endorsement of unrelated products, or a broader relationship than TrendRise approved.
  • Do not alter logos, create confusingly similar marks, use TrendRise branding in a way that suggests an official site, or combine TrendRise branding with unrelated brands in a confusing way.
  • Do not register domains, handles, groups, communities, ads, apps, extensions, pages, or accounts that use TrendRise marks or confusingly similar wording without written approval.
  • Do not scrape, clone, frame, or mirror TrendRise pages in a way that confuses customers about who operates the page.
  • Approved assets remain TrendRise property or licensed materials and may be revoked at any time.

Prohibited promotion methods

Partners may not promote TrendRise through spam, deception, coercion, unauthorized automation, illegal traffic, misleading ads, hidden tracking, or customer-confusing tactics.

  • Prohibited methods include unsolicited bulk email, unlawful SMS, misleading direct messages, fake communities, fake accounts, impersonation, malware, browser extensions that overwrite attribution, unauthorized coupon sites, deceptive review sites, forced opt-ins, lead harvesting, paid traffic from prohibited sources, or ads that imply TrendRise made a claim it did not make.
  • Partners may not promise refunds, discounts, bonus credits, custom support, plan access, legal advice, tax advice, data deletion, security exceptions, enterprise terms, or roadmap commitments that TrendRise has not approved.
  • Partners may not present themselves as TrendRise support, billing, legal, security, sales, or account-management staff.
  • Partners may not target children or sensitive audiences in ways that create legal, privacy, platform, or brand risk.
  • TrendRise may prohibit any promotional method that creates customer confusion, legal risk, platform risk, payment risk, brand harm, or unreasonable support burden.

Search ads, domains, and coupons

Partners may not bid on TrendRise branded search terms, misspellings, competitor confusion terms, or trademark-like keywords, or run ads that appear to be official TrendRise ads, without written approval.

  • Partners may not use TrendRise marks in ad headlines, display URLs, domains, subdomains, metadata, app listings, browser extensions, or social handles in a way that suggests official ownership.
  • Partners may not publish fake coupon pages, expired offer pages, unauthorized discount pages, or SEO pages that imply TrendRise approved a discount.
  • Partners may not intercept, overwrite, or claim commission for customers already navigating to TrendRise directly or through another Partner.
  • Partners may not use typosquatting, domain redirects, ad hijacking, affiliate toolbar injection, browser pop-ups, or other attribution capture tactics.

Email, SMS, direct messages, and communities

Partners are responsible for complying with email, SMS, direct-message, community, platform, and anti-spam laws and rules that apply to their promotional activity. TrendRise may require evidence of consent, opt-out handling, list ownership, platform permission, and compliant message practices before approving or continuing a campaign.

  • Commercial email must avoid false headers, deceptive subject lines, hidden advertising, missing sender identity, missing physical address where required, and missing opt-out mechanisms where required.
  • Partners must honor unsubscribe, stop, block, privacy, and platform moderation requests promptly.
  • Partners may not upload, rent, buy, scrape, or use email, phone, social, or community lists in ways that violate law, platform rules, privacy promises, or user consent.
  • If a Partner sends messages on TrendRise's behalf or in a campaign where TrendRise may have legal exposure, TrendRise may require pre-approval, suppression-list coordination, or immediate campaign shutdown.

Content deliverables and creator campaigns

Some Partners may participate in creator campaigns, launch collaborations, tutorials, reviews, sponsored content, webinars, newsletters, community launches, or product demos. Campaign-specific deliverables, deadlines, formats, approval rights, usage rights, exclusivity, and payment terms must be confirmed in writing.

  • Unless TrendRise agrees otherwise in writing, commission eligibility is separate from sponsored-content fees, flat fees, production reimbursements, media buys, or creator deliverable payments.
  • TrendRise may require draft review before paid posts, short-lived stories, ads, emails, webinars, or claims-heavy content go live.
  • Partners must preserve copies, URLs, screenshots, publication dates, disclosure proof, analytics, and deliverable records when reasonably requested.
  • TrendRise may decline to pay or may claw back campaign-specific compensation for missing deliverables, missing disclosures, false claims, unapproved content, or material breach of campaign terms.

Customer relationship and data limits

Customers referred by Partners are TrendRise customers for TrendRise account, product, billing, refund, privacy, support, security, and legal purposes. Partners may not access, collect, use, export, sell, or reuse TrendRise customer data unless TrendRise approves a specific workflow in writing.

  • TrendRise may limit or withhold customer-level data for privacy, security, legal, contractual, or product reasons.
  • Partner dashboards may show aggregated performance, pseudonymous records, masked emails, or limited ledger details instead of full customer data.
  • Partners may not ask customers for TrendRise passwords, payment card data, private workspace content, credit ledgers, source results, generated outputs, API keys, or sensitive personal information.
  • If a Partner receives customer information independently through its own lawful relationship, the Partner is responsible for its own privacy notice, consent, security, retention, deletion, and legal obligations.

Confidentiality

Partners may receive non-public TrendRise information, including dashboard data, commission records, conversion data, customer context, product roadmap information, pricing experiments, campaign strategy, private assets, beta access, security notes, or support context. Partners must protect that information and use it only for approved Partner activity.

  • Confidential information may not be disclosed, sold, published, benchmarked, reverse engineered, used to compete unfairly, or shared with third parties except approved contractors who need it and are bound to protect it.
  • Partners must promptly report accidental disclosure, unauthorized access, or suspected misuse of confidential information.
  • Confidentiality duties continue after Partner access ends.
  • Information that is public through no breach, independently developed without TrendRise confidential information, or lawfully received from another source may not be confidential, but the Partner should be able to prove that status.

Payout setup and Stripe Connect

Partners are responsible for payout setup, identity verification, tax information, bank details, invoices where required, and their own taxes. TrendRise may use Stripe Connect hosted onboarding or another payment provider where available.

  • Stripe or another provider may collect identity, tax, compliance, and bank details directly. TrendRise should store only connected-account ids, readiness metadata, payout references, and operational records it needs.
  • No payout is owed until commission is eligible, payable, above any threshold, not frozen, not reversed, not under review, and payout setup is complete.
  • Payout setup can remain restricted if Stripe, a bank, a payment provider, sanctions screening, tax review, fraud review, or TrendRise requires more information.
  • TrendRise may delay, reject, or cancel payouts if a Partner does not complete onboarding, provide accurate tax information, satisfy verification, or comply with these Partner Terms.

Manual payout fallback

Until Stripe Connect or another automated payout path is production-ready for a Partner, TrendRise may pay approved Partner payout previews manually outside Stripe and then mark the related commission paid in TrendRise records.

  • Manual payout is an operational fallback, not a guarantee that all Partners will receive manual payouts.
  • Manual payouts may require additional invoices, tax forms, identity checks, banking details, payment confirmations, admin approval, and reconciliation notes.
  • TrendRise may require a payout preview, checkbox-confirmed admin approval, scheduled payout state, and paid confirmation before marking commission paid.
  • If a manual payout is later affected by refund, dispute, fraud, mistake, or overpayment, TrendRise may apply negative adjustments or request repayment.

Taxes and records

Partners are responsible for determining, reporting, collecting, withholding, filing, and paying all taxes, duties, social contributions, registrations, and filings related to Partner income, unless TrendRise is legally required to withhold or report amounts.

  • TrendRise may request tax forms, business information, residency information, VAT/GST details, invoices, or other documentation before paying.
  • TrendRise may withhold amounts, delay payouts, or decline payouts where required by law, provider requirements, missing documentation, sanctions restrictions, or tax review.
  • Partners should keep their own accounting records because dashboard records may be estimates and may not match tax forms, provider reports, or bank records.
  • TrendRise may retain Partner payout, tax, ledger, refund, dispute, fraud, compliance, and support records for legal, accounting, tax, security, and audit purposes.

Compliance with laws and platform rules

Partners must comply with applicable laws, regulations, platform rules, advertising rules, endorsement rules, privacy rules, email/SMS rules, tax rules, sanctions laws, export controls, payment-provider rules, intellectual-property rules, and consumer-protection obligations.

  • Partners are responsible for understanding the rules in the countries, states, platforms, channels, and audiences where they promote TrendRise.
  • If U.S. consumers may be affected, U.S. advertising and endorsement rules may apply even when a Partner posts from outside the United States.
  • Partners may not promote TrendRise to sanctioned persons, embargoed regions, prohibited industries, illegal businesses, or audiences TrendRise identifies as restricted.
  • TrendRise may require Partners to stop campaigns, remove content, provide compliance evidence, update disclosures, or complete training.

Monitoring and enforcement

TrendRise may monitor Partner activity, public content, referral traffic, complaints, platform reports, support tickets, ad libraries, campaign examples, disclosure quality, attribution patterns, refunds, disputes, and payout risk to protect customers and the program.

  • TrendRise may request screenshots, URLs, analytics, message samples, ad examples, disclosure examples, audience information, list-consent evidence, and campaign records.
  • TrendRise may require corrective action, updated copy, additional disclosures, content removal, link deactivation, commission freeze, payout delay, retraining, audit, suspension, or termination.
  • TrendRise may report unlawful or platform-violating conduct to providers, platforms, payment processors, regulators, or law enforcement where appropriate.
  • TrendRise's failure to enforce a rule once does not waive the right to enforce it later.

Suspension and termination

Either party may end Partner participation unless a signed agreement says otherwise. TrendRise may immediately suspend or terminate Partner access for policy violations, misleading promotion, suspicious attribution, legal risk, fraud, payment risk, brand harm, customer harm, missing verification, sanctions risk, inactivity, or unreasonable support burden.

  • Suspension may disable referral links, Partner codes, dashboards, payouts, attribution, approved assets, and campaign permissions.
  • Termination does not automatically eliminate valid payable commissions already earned, but unpaid commissions remain subject to holds, refunds, disputes, reversals, thresholds, negative balances, tax review, fraud review, and compliance review.
  • After termination, Partners must stop using TrendRise referral links, codes, assets, claims, confidential information, and campaign materials unless TrendRise allows continued use in writing.
  • TrendRise may permanently withhold unpaid commission tied to fraud, deception, legal violation, prohibited traffic, missing disclosures, unauthorized claims, or material breach.

Program changes

TrendRise may change commission rates, eligibility rules, attribution windows, payout schedules, payout thresholds, hold periods, approved assets, Partner surfaces, dashboard fields, program availability, or campaign rules prospectively. Material changes should be communicated through the Partner dashboard, email, signed notice, or other reasonable channel where appropriate.

  • TrendRise may run experiments, private campaigns, regional campaigns, time-limited offers, invite-only offers, and campaign-specific rate cards.
  • Changes may apply immediately where needed for legal compliance, fraud prevention, platform requirements, payment risk, security, privacy, brand protection, or product integrity.
  • Continued use of Partner links, codes, dashboard access, assets, or program benefits after an update may mean acceptance of the updated Partner Terms, subject to applicable law.
  • TrendRise may discontinue the Partner program or a specific Partner offer at any time unless a signed agreement says otherwise.

No guarantees

TrendRise does not guarantee Partner earnings, customer conversion, attribution continuity, dashboard accuracy at all times, commission availability, payout timing, campaign approval, audience performance, product results, platform reach, creator performance, or customer retention.

  • Traffic, clicks, signups, trials, checkout starts, conversion estimates, and projected commission do not guarantee payable commission.
  • Partner dashboards, analytics, attribution records, and payout queues may be delayed or unavailable because of product changes, provider downtime, privacy limits, fraud review, maintenance, or reconciliation.
  • TrendRise may correct mistakes, remove invalid records, and update calculations.

Indemnity and liability draft

To the fullest extent allowed by law and subject to counsel review, Partners should be responsible for claims, losses, damages, penalties, fees, and expenses arising from their breach of these Partner Terms, unlawful promotion, missing disclosures, misleading claims, spam, privacy violations, intellectual-property misuse, tax obligations, fraud, or unauthorized commitments.

  • Counsel should decide the final indemnity wording, liability cap, exclusions, defense-control process, notice process, and whether different rules apply to consumers, creators, agencies, or business Partners.
