Terms of use

The contract layer for using TrendRise.

A detailed, product-specific Terms draft covering company identity placeholders, accounts, subscriptions, credits, digital service delivery, refunds, disputes, AI outputs, source data, exports, Partner activity, acceptable use, and legal-review items.

Agreement and contracting party

These Terms of Use are the agreement between you and the TrendRise legal entity that operates TrendRise.io. They govern your access to the TrendRise website, application, documentation, support surfaces, subscriptions, credits, generated outputs, exports, Partner surfaces, referral links, and related services.

  • These Terms are written as a lawyer-review-ready operating draft and must be reviewed by counsel before final public launch.
  • The final company legal name, registered address, tax or VAT details, governing law, and notice address should be inserted before launch.
  • By creating an account, clicking to accept, starting Checkout, using paid features, spending credits, joining a workspace, accepting Partner access, or continuing after an update, you agree to these Terms.
  • If you use TrendRise on behalf of a company, agency, client, creator business, or other organization, you represent that you have authority to bind that organization.

What TrendRise is

TrendRise is product opportunity intelligence and launch workflow software for builders, brands, agencies, creators, and teams. The service helps users identify rising market signals, research demand, shape simple product concepts, plan launches, organize creator or Partner distribution, and track early learning.

  • TrendRise is software-as-a-service, not a physical product, marketplace, payment processor, legal adviser, tax adviser, financial adviser, medical adviser, or guaranteed business-results program.
  • TrendRise may support digital-product workflows such as PDFs, planners, workbooks, checklists, scripts, templates, product briefs, launch plans, and export packages.
  • TrendRise may also support existing products, physical products, service offers, Shopify, Etsy, Amazon, KDP, creator, affiliate, and external launch workflows as planning or analysis surfaces.
  • TrendRise converts source signals into hypotheses. You are responsible for validating opportunities before relying on them commercially.

Important product limitations

TrendRise can help you make better product and launch decisions, but it does not remove business risk. Market data, source coverage, AI-generated content, creator fit, demand scores, trend labels, and launch recommendations can be incomplete, stale, inaccurate, or unsuitable for your specific use.

  • TrendRise does not guarantee traffic, sales, profit, search volume, trend continuation, advertising performance, creator response, refund rate, conversion rate, product-market fit, compliance, or customer satisfaction.
  • Scores, labels, dashboards, reports, and recommendations are decision-support tools, not instructions you must follow.
  • You are responsible for product quality, customer claims, checkout copy, refund copy, ads, emails, creator briefs, disclosures, legal review, tax treatment, platform compliance, and final publishing decisions.
  • You should not use TrendRise outputs as the only basis for regulated, high-stakes, professional, legal, financial, medical, safety, employment, insurance, or compliance decisions.

Definitions

These definitions help explain these Terms and should be finalized by counsel with the final contract style.

  • "TrendRise," "we," "us," and "our" mean the TrendRise operator and its authorized service providers.
  • "You" and "Customer" mean the person or organization using the service, including users invited into a workspace.
  • "Workspace" means the account environment where users save opportunities, research, generated outputs, product drafts, launch materials, Partner records, and settings.
  • "Credits" or "tokens" mean the internal usage meter for eligible paid actions. They are not cash, stored value, gift cards, electronic money, or transferable property.
  • "Generated Outputs" means AI-assisted, automated, template-based, or system-generated reports, briefs, drafts, scripts, summaries, plans, artifacts, exports, recommendations, and similar materials.
  • "Source Data" means public, provider-supplied, uploaded, cached, licensed, integrated, or customer-authorized information used to inform TrendRise workflows.

Account eligibility

TrendRise is intended for lawful business, product-development, creator, agency, research, and launch-planning use. You must be old enough to form a binding contract where you live, and you may not use TrendRise if you are barred from doing so under applicable law.

  • You must provide accurate registration, billing, Partner, and workspace information and keep it current.
  • You may not create accounts using false identities, misleading organizations, disposable abuse patterns, or information you are not authorized to use.
  • TrendRise may refuse, suspend, or terminate access where an account appears fraudulent, abusive, unsafe, legally restricted, or likely to create payment, security, legal, or reputational risk.

Account security

You are responsible for protecting your account credentials, devices, sessions, email account, workspace invitations, and connected services. Activity under your account or workspace may be treated as your activity unless TrendRise determines otherwise.

  • Use strong authentication and notify support@trendrise.io promptly if you suspect unauthorized access.
  • You are responsible for users you invite, permissions you grant, and information your team adds to a workspace.
  • TrendRise may require verification before discussing account, billing, privacy, security, workspace, or Partner records.
  • TrendRise may disable sessions, rotate credentials, pause access, or require additional checks if security risk is detected.

Workspaces and roles

Workspaces may support owners, administrators, members, clients, creators, Partners, or other roles as the product matures. A workspace owner or administrator is responsible for managing access, permissions, and use of workspace data.

  • Workspace roles may control access to billing, credits, product workflows, source searches, generated outputs, exports, Partner records, and settings.
  • If you join a workspace controlled by another organization, that organization may manage access, remove you, export or delete certain data, and view workspace activity.
  • If workspace ownership is disputed, TrendRise may rely on billing records, verified account information, domain ownership, written authorization, or other reasonable evidence.
  • TrendRise may provide limited administrative help but is not responsible for internal disputes between founders, agencies, clients, team members, or Partners.

Plans and paid access

TrendRise may offer free, trial, beta, monthly, annual, agency, usage-based, credit-based, custom, promotional, or enterprise plans. Plan features, limits, included credits, prices, billing cycles, and availability may differ by plan, region, customer type, or offer.

  • Paid access may include subscriptions, credit grants, feature access, saved-output reuse, source-search allowances, exports, Partner features, or other plan benefits.
  • Plan descriptions on the pricing page, Checkout page, order form, in-app billing page, or signed agreement control the commercial terms for that purchase.
  • TrendRise may add, remove, bundle, unbundle, rename, limit, or change features prospectively, subject to applicable law and any specific written agreement.
  • Free, beta, trial, discounted, promotional, or grandfathered access may be modified, limited, or ended unless a written agreement says otherwise.

Billing and renewals

Paid subscriptions renew automatically unless cancelled before the renewal date or unless the applicable Checkout flow, order form, invoice, or written agreement says otherwise. You authorize TrendRise and its payment provider to charge the payment method on file for recurring fees, taxes, and other amounts due.

  • Stripe or another payment provider may process payments, payment methods, invoices, receipts, refunds, tax information, fraud checks, disputes, and payment-provider records.
  • Prices may be listed before taxes, currency conversion, bank fees, card fees, or payment-provider fees unless stated otherwise.
  • If payment fails, TrendRise may retry the charge, downgrade the workspace, suspend paid features, stop credit grants, restrict exports, or terminate access.
  • A customer remains responsible for charges incurred before cancellation, downgrade, suspension, or termination.

Taxes

You are responsible for taxes, duties, levies, withholding, reporting obligations, reverse-charge treatment, VAT, sales tax, use tax, GST, and similar charges connected to your purchase or use of TrendRise, except for taxes based on TrendRise's income.

  • TrendRise or its payment provider may calculate, collect, report, or remit taxes where required or configured.
  • You must provide accurate tax, billing, business, location, exemption, and VAT information when requested.
  • If you are required to withhold taxes, you must gross up payment unless a written agreement says otherwise, subject to counsel review.

Credits and usage meter

Credits are an internal usage meter for eligible TrendRise actions. Credits help allocate expensive research, intelligence, generation, export, source, AI, artifact, and workflow activity across plans. Credits have no cash value and are not a bank balance, stored value, gift card, cryptocurrency, or transferable asset.

  • Credits may be granted monthly, purchased, included in a plan, awarded manually, restored after a failed action, or adjusted by support.
  • Credits may expire, reset, be capped, or become unavailable when a plan ends, renews, downgrades, is cancelled, or is suspended.
  • TrendRise may change credit costs, included credits, action categories, caps, and plan allowances prospectively.
  • Credit ledger records may include action type, workspace, user, timestamp, policy version, provider, model, status, generated-output reference, source-search reference, export reference, and cost metadata.

Credit-consuming actions

Some actions may spend credits before a final output appears, when the action begins processing, when a provider call starts, or when TrendRise reserves capacity for the job. The product may show a confirmation, cost estimate, percent-of-plan estimate, or warning before eligible actions.

  • Examples may include market-fit reports, product briefs, price positioning, validation plans, go-to-market reports, full drafts, UGC scripts, outreach drafts, export packages, artifact preparation, source searches, and similar intelligence jobs.
  • Repeated access to a saved output should generally not spend credits again unless the user requests a new run, comparison, regeneration, replacement, or additional output.
  • If a job fails before useful service is delivered, TrendRise may retry the job, restore credits, issue a usage adjustment, or provide another operational remedy.
  • Credit restoration does not necessarily create a right to cash refund.

Digital delivery and service start

TrendRise is delivered digitally through the website and app. Service can begin immediately after account access, plan activation, credit grant, Checkout completion, source-search start, credit-consuming job start, generated-output delivery, export preparation, artifact creation, or use of a paid feature.

  • You agree that digital access, credits, generated outputs, reports, exports, artifacts, source checks, and workflow actions can begin immediately after purchase or confirmation.
  • Usage records, credit ledger entries, job records, generated outputs, saved reports, source-search records, artifact versions, export manifests, login records, and support records may show digital service delivery.
  • Digital service delivery does not require physical shipment, manual delivery, customer download, or customer use of every output.
  • Where mandatory law requires specific consent or acknowledgement for immediate digital performance, TrendRise's final Checkout wording should be reviewed by counsel.

Cancellations

You may cancel a subscription through the billing portal, account settings, or support channel when available. Cancellation stops future renewals, but it does not automatically refund the current billing period, unused access, unused credits, or partially used services unless required by law or approved by TrendRise.

  • You should cancel before the renewal date if you do not want the subscription to renew.
  • Plan downgrades or cancellations may reduce available credits, feature access, source-search capacity, exports, team seats, Partner features, and workspace limits.
  • TrendRise may retain billing, credit, tax, dispute, fraud-prevention, security, support, and legal records after cancellation.
  • Deleting an account, abandoning a workspace, failing to use the product, or not logging in does not automatically cancel paid access.

Refund policy

The Refund Policy is incorporated into these Terms. The default commercial position is that TrendRise generally does not provide cash refunds for subscriptions, digital access, credits, generated outputs, source checks, exports, artifacts, or paid workflow activity once access has begun or credits have been spent, except where required by law or where TrendRise approves an exception.

  • TrendRise may consider refunds or credit remedies for duplicate charges, confirmed billing errors, unauthorized charges reported promptly, material service failures, or legal rights that require a remedy.
  • Dissatisfaction with market results, creator response, sales, traffic, trend accuracy, generated recommendations, product outcomes, or failure to cancel before renewal generally does not create a refund right.
  • If a credit-consuming action fails without useful service delivery, TrendRise may restore credits, retry the job, or provide another operational remedy instead of a cash refund.
  • Mandatory consumer rights, including EU/UK rights where applicable, override any conflicting part of these Terms.

Chargebacks and payment disputes

If you dispute a charge with your bank, card issuer, or payment provider, TrendRise may respond through Stripe or another payment provider. TrendRise may submit evidence showing that the Terms and Refund Policy were disclosed, that you received access, and that digital services or credits were used.

  • Evidence may include Checkout metadata, policy version, invoice records, payment records, account email, workspace id, access dates, login activity, credit grants, credit deductions, generated-output records, source-search records, export records, support messages, cancellation history, and prior refund decisions.
  • TrendRise may explain why a refund is not owed when access began, credits were spent, or digital service activity was delivered.
  • Filing a dispute may trigger account review, access limitation, fraud review, suspension of credit-consuming actions, or Partner commission freezes where relevant.
  • Nothing in this section limits rights that cannot be limited under applicable payment-network or consumer-protection law.

Consumer rights and regional rules

Some customers may have mandatory rights that vary by location, including pre-contract information rights, cancellation rights, digital-content remedies, faulty-service remedies, unfair-term protections, or local consumer guarantees. These Terms do not limit rights that cannot be waived by contract.

  • EU/UK consumer rules may require specific information before purchase and may treat digital content, digital services, immediate performance, and withdrawal rights differently depending on the transaction.
  • Customers buying for a business may have different rights than consumers buying for personal use.
  • If TrendRise targets additional regions, counsel should review local consumer, auto-renewal, tax, privacy, cookie, email, advertising, and AI rules before launch.
  • If a mandatory law conflicts with these Terms, the mandatory law controls for that issue only.

User content ownership

You retain ownership of prompts, uploads, notes, product ideas, opportunity decisions, launch materials, customer context, creator lists, workspace comments, and other content you submit to TrendRise, subject to any rights held by others.

  • You represent that you have the rights and permissions needed to submit, process, transform, and use your content in TrendRise.
  • You grant TrendRise a limited, worldwide, non-exclusive license to host, store, copy, process, display, transmit, transform, generate from, secure, support, and operate on your content to provide and improve the service.
  • You are responsible for reviewing whether your inputs or outputs include confidential, regulated, copyrighted, trademarked, personal, or third-party information.
  • TrendRise may preserve records needed for billing, tax, security, legal, fraud-prevention, dispute, backup, support, and compliance purposes.

Sensitive data limits

TrendRise is not designed for unnecessary sensitive data. Unless TrendRise expressly agrees in writing, you must not upload or submit payment card numbers, bank credentials, passwords, private keys, seed phrases, government identifiers, health information, children's data, highly sensitive personal data, or confidential third-party data you are not authorized to process.

  • Do not paste secrets, API keys, recovery codes, private tokens, or payment details into prompts, generated workflows, support messages, or workspace fields.
  • If you accidentally submit sensitive information, notify support or privacy promptly so TrendRise can assess reasonable deletion or mitigation steps.
  • TrendRise may remove, restrict, or disable content that creates legal, privacy, security, or provider-policy risk.

Generated outputs

Generated Outputs may be created by TrendRise systems, templates, scoring rules, AI models, source processors, or third-party providers. Outputs can be useful but may also be incomplete, inaccurate, non-unique, outdated, biased, unsafe, non-compliant, or similar to outputs generated for other users.

  • You must review, edit, fact-check, test, and approve outputs before using them publicly or commercially.
  • You are responsible for customer-facing claims, product promises, pricing, guarantees, endorsements, refund copy, ads, emails, creator scripts, storefront copy, and legal compliance.
  • TrendRise does not guarantee that outputs are original, exclusive, copyrightable, non-infringing, platform-compliant, accurate, profitable, or fit for a specific purpose.
  • You should not represent AI-assisted outputs as human-created, independently verified, legally approved, or guaranteed unless you have independently confirmed that claim.

Output ownership and reuse

Subject to your compliance with these Terms, TrendRise generally permits you to use Generated Outputs created for your workspace for your internal business and commercial product-development purposes. This permission does not give you ownership of TrendRise software, templates, scoring systems, underlying models, source data, provider technology, or materials owned by others.

  • Other users may receive similar or overlapping outputs because ideas, trends, formats, templates, prompts, public facts, and AI-generated text may not be unique.
  • TrendRise may use aggregated, de-identified, or operational usage patterns to improve the service, subject to the Privacy Policy and any applicable DPA.
  • TrendRise may retain internal records of generated-output metadata for billing, quality, support, safety, abuse prevention, dispute handling, and product improvement.
  • If an output includes third-party material, public-source references, trademarks, names, likenesses, or regulated claims, you are responsible for clearing rights and compliance before use.

Source data and research

TrendRise may use public information, cached source records, provider APIs, user-authorized data, uploaded data, marketplace data, search signals, social signals, ad signals, creator data, ecommerce data, and other source inputs to support opportunity research. Source Data is not guaranteed to be complete, current, lawful for every use, or free from provider limits.

  • Source availability, API permissions, scraping rules, provider pricing, rate limits, terms, fields, geography, and coverage may change without notice.
  • TrendRise may cache, normalize, score, summarize, suppress, omit, or transform Source Data for product purposes.
  • You may not use TrendRise to access, scrape, export, republish, or misuse data in violation of law, platform rules, provider terms, or third-party rights.
  • Raw source signals and scored opportunities are separate: a score is a hypothesis, not proof of demand or a promise of results.

Products, exports, and artifacts

TrendRise may help create product profiles, outlines, drafts, scripts, launch assets, export packages, private file versions, artifact records, review states, and delivery-readiness materials. These are workflow assets and may require additional human review, editing, design, legal review, and publishing work before customer delivery.

  • A TrendRise export or artifact is not automatically a finished, legally compliant, customer-ready, publicly hosted, or commercially successful product.
  • You are responsible for final file quality, accessibility, formatting, proofreading, product claims, customer instructions, refund/support copy, storefront publishing, and delivery systems.
  • Private artifact storage, review states, replacement queues, and export manifests may be beta or internal workflow features until final production delivery rules are launched.
  • TrendRise may remove or disable artifacts that violate these Terms, provider rules, law, or third-party rights.

Existing products and external channels

TrendRise may support planning and analysis for products sold or managed outside TrendRise, including Shopify, Etsy, Amazon, KDP, Gumroad, Stripe, creator channels, ads, email, or other external systems. TrendRise is not responsible for those platforms or for transactions you conduct outside TrendRise.

  • You are responsible for external storefronts, checkout settings, customer delivery, taxes, platform compliance, customer support, refunds, disputes, and product quality outside TrendRise.
  • External platform metrics, imported records, attribution, sales estimates, or analytics may be incomplete or delayed.
  • TrendRise may provide setup checklists or launch-readiness guidance, but you control whether and how an external product is launched.

Partner and referral activity

TrendRise may operate a Partner program for creators, affiliates, agencies, communities, consultants, or other promoters. Partner activity is governed by these Terms, the Partner Terms, the Privacy Policy, the Cookie Policy, the Refund Policy, and any written Partner agreement.

  • Partners must use approved links, codes, claims, assets, and disclosures.
  • Customers should understand that Partner links may support attribution and commission eligibility.
  • Refunds, disputes, payment failures, fraud review, coupon abuse, self-referrals, policy violations, and suspicious activity may delay, freeze, reverse, or deny Partner commission.
  • The current TrendRise-owned Partner operating model includes a 90-day attribution window and a 20-day commission hold unless a specific offer or agreement says otherwise.

Advertising and endorsement rules

You and any Partner, creator, agency, contractor, or affiliate promoting TrendRise or products planned with TrendRise must comply with applicable advertising, endorsement, consumer-protection, email, SMS, platform, and influencer rules.

  • Commercial relationships, affiliate links, paid promotion, free access, referral compensation, sponsorships, and material connections must be clearly and conspicuously disclosed where required.
  • You may not make unsupported income claims, guaranteed-result claims, fake scarcity claims, fake testimonials, misleading reviews, or claims that TrendRise has approved a product, result, or legal position unless TrendRise has expressly done so in writing.
  • You may not bid on TrendRise branded search terms, impersonate TrendRise, or present yourself as TrendRise support, sales, legal, or billing unless authorized in writing.

Third-party services

TrendRise relies on third-party services for hosting, databases, authentication, billing, payment processing, email, AI/model processing, source data, analytics, observability, support, storage, and Partner payout readiness. Third-party services may have their own terms, privacy practices, limits, fees, errors, outages, and compliance requirements.

  • Stripe or another payment provider may handle payment methods, invoices, refunds, disputes, tax fields, fraud checks, and Connect onboarding.
  • Clerk or another authentication provider may handle sign-in, sessions, identity, and account security workflows.
  • AI/model and source-data providers may process prompts, source queries, workspace context, and generated-output requests where enabled.
  • TrendRise is not responsible for third-party services beyond what applicable law or a written agreement requires.

Acceptable use

You may use TrendRise only for lawful, authorized, and good-faith purposes. You may not use the service to harm TrendRise, other users, customers, Partners, providers, platforms, or the public.

  • Do not violate laws, contracts, platform rules, intellectual-property rights, privacy rights, publicity rights, consumer-protection rules, payment rules, or export/sanctions rules.
  • Do not upload malware, run attacks, probe systems without permission, bypass security, overload the service, scrape the app, reverse engineer, or interfere with operations.
  • Do not use TrendRise for spam, phishing, credential theft, fake engagement, deceptive marketing, impersonation, harassment, hate, exploitation, illegal goods, illegal services, or unsafe products.
  • Do not use TrendRise to create misleading product claims, fake reviews, false testimonials, undisclosed endorsements, counterfeit goods, or deceptive refund/cancellation practices.
  • Do not resell, sublicense, rent, white-label, benchmark publicly, or provide TrendRise as a service bureau unless TrendRise approves it in writing.

Intellectual property and brand

TrendRise owns or licenses the service, software, design, workflows, scoring systems, prompts, templates, user interface, docs, trade dress, brand assets, logos, and related materials. These Terms do not transfer ownership of TrendRise intellectual property to you.

  • You may not copy, modify, distribute, frame, scrape, mirror, reverse engineer, or create a competing service from TrendRise materials except where law allows or TrendRise gives written permission.
  • You may not use TrendRise names, logos, screenshots, badges, or brand assets in a way that suggests endorsement, partnership, certification, or sponsorship unless approved in writing.
  • Product documentation may be used internally to learn the service, but it may not be republished as competing documentation or training material without permission.
  • Feedback, suggestions, and ideas you provide may be used by TrendRise without compensation or obligation to you.

Privacy and data processing

The Privacy Policy, Cookie Policy, Subprocessors page, Security page, and any signed Data Processing Addendum explain how TrendRise handles personal data, cookies, security, providers, and business-customer processing terms. Those documents are incorporated into these Terms where relevant.

  • You are responsible for deciding what data to submit and for having a lawful basis and required notices for any personal data you add to TrendRise.
  • If you need a DPA, subprocessor terms, security review, or enterprise privacy terms, contact legal@trendrise.io before submitting regulated or sensitive data.
  • TrendRise may process account, billing, credit, usage, support, security, and dispute records as described in the Privacy Policy.

Security and service protection

TrendRise uses reasonable technical and organizational measures designed to protect the service, but no online service is perfectly secure. You must use the service in a way that supports security and does not expose unnecessary risk.

  • Report suspected vulnerabilities or account compromise to security@trendrise.io.
  • Do not publicly disclose vulnerabilities or access data that does not belong to you.
  • TrendRise may monitor usage, logs, provider events, payment events, and security signals to detect abuse, fraud, outages, and policy violations.
  • TrendRise may throttle, block, suspend, or require verification for traffic or usage that appears unsafe, abusive, automated, or provider-risky.

Beta features and previews

TrendRise may offer beta, preview, demo, experimental, unfinished, fixture-safe, local-only, or limited-access features. Beta features may be incomplete, unstable, inaccurate, visually unfinished, disabled, or subject to change without notice.

  • Demo routes may use fixture data and should not be treated as production behavior unless TrendRise says otherwise.
  • Beta features may not include final billing, credit, source, Partner, export, customer-delivery, support, privacy, or security behavior.
  • TrendRise may remove beta data, disable beta features, or change beta workflows at any time.
  • Do not rely on beta features for production launches unless TrendRise has confirmed they are production-ready.

Support

TrendRise may provide support through email, support pages, documentation, in-app notices, or other channels. Support availability, response times, and scope may vary by plan, issue type, customer status, and operational capacity.

  • Use support@trendrise.io for product help, billing@trendrise.io for billing and refunds, privacy@trendrise.io for privacy requests, security@trendrise.io for security issues, and legal@trendrise.io for legal notices.
  • Support may ask for verification before changing account, billing, workspace, Partner, payout, or privacy records.
  • Support guidance is not legal, tax, financial, medical, or regulated professional advice.

Service changes and availability

TrendRise may change, suspend, replace, limit, or discontinue parts of the service, including features, routes, docs, integrations, providers, source adapters, AI models, plan packaging, pricing, credit costs, beta features, and exports.

  • The service may be interrupted by maintenance, infrastructure failures, source-provider changes, rate limits, AI-provider outages, payment-provider issues, security incidents, or force majeure events.
  • TrendRise may provide notice of material changes where required or where reasonably practical.
  • TrendRise is not required to maintain every feature, provider, source field, model, route, or beta workflow indefinitely.

Suspension and termination

TrendRise may suspend, limit, or terminate access if you violate these Terms, fail to pay, misuse credits, abuse support, create security or legal risk, submit fraudulent payment activity, file abusive disputes, infringe rights, or use TrendRise in a way that could harm TrendRise, users, customers, Partners, providers, platforms, or the public.

  • Suspension may affect account access, workspaces, credits, source searches, exports, generated outputs, Partner dashboards, payout readiness, support, and API or integration access.
  • TrendRise may preserve records after termination where needed for billing, tax, legal, security, backup, fraud-prevention, payment-dispute, Partner-commission, support, or compliance reasons.
  • You remain responsible for amounts incurred before termination.
  • If a Partner account is terminated, unpaid commissions remain subject to holds, refunds, disputes, reversals, fraud review, thresholds, tax documentation, and payout readiness.

Warranty disclaimer

To the maximum extent permitted by law, TrendRise is provided on an as-is and as-available basis. TrendRise disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, uninterrupted operation, data completeness, and business results.

  • TrendRise does not warrant that the service will be error-free, secure, uninterrupted, profitable, compliant for your use, or compatible with every platform or workflow.
  • TrendRise does not warrant that source data, AI outputs, forecasts, scores, recommendations, Partner matches, analytics, or generated artifacts will be accurate, complete, current, unique, or successful.
  • Some jurisdictions do not allow certain disclaimers, so some disclaimers may not apply to you.

Limitation of liability

To the maximum extent permitted by law, TrendRise and its owners, employees, contractors, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, or for lost profits, lost revenue, lost data, lost goodwill, lost opportunities, business interruption, reputational harm, or cost of substitute services.

  • A final liability cap should be inserted by counsel, commonly tied to amounts paid by the customer during a defined period or another negotiated amount.
  • The liability cap should include appropriate carveouts for amounts that cannot be limited under applicable law.
  • Nothing in these Terms limits liability that cannot legally be limited, such as liability for fraud or other non-waivable rights where applicable.

Counsel should finalize the exact liability cap, exclusions, consumer carveouts, and governing-law enforceability before launch.

Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless TrendRise and its owners, employees, contractors, affiliates, service providers, and licensors from claims, damages, losses, liabilities, costs, and expenses arising from your use of TrendRise, your content, your products, your customer-facing claims, your violation of these Terms, or your violation of law or third-party rights.

  • Indemnity may apply to your ads, emails, storefronts, products, digital downloads, creator briefs, Partner promotions, customer promises, uploaded data, generated-output use, platform violations, and external sales channels.
  • TrendRise should provide notice and reasonable cooperation for indemnified claims, subject to counsel review.
  • Consumer-law limits and local enforceability should be reviewed before final launch.

Dispute resolution placeholder

The final governing law, venue, arbitration, class-action waiver, small-claims procedure, informal dispute period, injunctive-relief rights, and consumer-law carveouts must be selected by counsel based on the TrendRise legal entity, target markets, and risk tolerance.

  • Do not treat this draft as final on governing law or dispute forum.
  • If TrendRise sells to EU, UK, or other international consumers, counsel should review mandatory consumer forum and choice-of-law rules.
  • If TrendRise sells mainly to businesses, counsel may choose a different dispute structure than for consumer sales.

Export, sanctions, and restricted use

You may not use TrendRise where prohibited by export-control, sanctions, anti-corruption, anti-money-laundering, or other applicable laws. You may not use TrendRise for restricted end uses or restricted parties.

  • You represent that you are not located in, organized under, or ordinarily resident in a prohibited jurisdiction where use would be unlawful.
  • You represent that you are not on a restricted-party list that would make access unlawful.
  • TrendRise may restrict access, payments, Partner payouts, or support where sanctions, export, fraud, or compliance risk is identified.

Notices

TrendRise may provide notices through the website, app, account email, billing provider, support channel, Partner dashboard, documentation, or other reasonable methods. You are responsible for keeping your email and billing information current.

  • Legal notices to TrendRise should be sent to legal@trendrise.io unless a final legal address is added to these Terms.
  • Billing notices should be sent to billing@trendrise.io.
  • Privacy notices should be sent to privacy@trendrise.io.
  • Security notices should be sent to security@trendrise.io.

Changes to these terms

TrendRise may update these Terms as the service, providers, laws, pricing, credits, Partner program, AI features, source data, security posture, or business model changes. Material changes should be communicated where required by law or where reasonably practical.

  • The updated date and policy version should be preserved for support, billing, dispute, and legal review.
  • Continued use after an update may mean you accept the updated Terms, subject to applicable law.
  • If you do not agree to updated Terms, you should stop using TrendRise and cancel paid access before the next renewal.

Order of terms

If there is a conflict between these Terms and another TrendRise policy, the more specific document controls for that subject unless a signed written agreement says otherwise.

  • The Refund Policy controls operational refund and credit-remedy details.
  • The Privacy Policy, Cookie Policy, Subprocessors page, Security page, and DPA control privacy, cookies, providers, security, and data-processing topics.
  • The Partner Terms control Partner applications, referral attribution, commission eligibility, reversals, and payouts.
  • A signed order form, enterprise agreement, or Partner agreement may override public terms for that customer or Partner.
